Terms and Conditions:

CANCELLATION FEE: 

Every effort will be made to reschedule the cancellation. A fee of £25 will be charged if the driving lesson is cancelled by the student 48 hours before the booking. The full lesson fee will be charged if the student cancels 24 hours before the lesson.  

1. INSURANCE: All fees include pupil cover whilst driving the School vehicle, (provided the pupil is licensed to drive), and is accompanied by, or under the direction of a Driving Standards Agency A.D.I (Car) . A fee will be applied for use of the car for the driving test.

2. FEES: All hourly driving lessons are subject to a minimum 2 working days (48 hours) notice for any cancellations. The School retains the right to charge a full tuition fee if the above notice is not given.

3. PAYMENTS: We accept payment by either Cash,Cheque or PayPal (supported by a cheque guarantee card) no cheques will be accepted from persons under 18 years old. Pre-payment lessons are accepted on the understanding no refunds will be given.

4. APPOINTMENTS: i) While every care will be taken to ensure Pupils receive training at the requested time, all bookings are made on the understanding that the School is not responsible for the postponement of training due to traffic conditions, adverse weather conditions, mechanical breakdown of equipment or any other cause outside of our control. ii) If in the view of the Instructor, the pupil is unfit to carry out the lesson safely, due to self-induced circumstances (e.g. Alcohol or Drugs) a cancellation charge will apply.

5. BOOKS AND TRAINING MATERIAL: All question papers, hand outs, books, C.D. ROMs and relevant materials remain the property of the Driving School. (If not returned on request a fee will be charged).

6. THE DRIVING TEST: The school reserves the right to withhold the training vehicle, if in the Instructors opinion, the pupil does not reach the required standard. The school cannot be held responsible for Test Appointments being postponed or cancelled by the Driving Standards Agency. Furthermore we are not responsible for any failure of light bulbs etc during the Practical test. All bulbs/lights etc will be checked at the test centre prior to the test, with the candidate. A fee of £8.50 will be charged if we book or alter your driving test on your behalf. If we book a practical test on a pupils behalf and do not receive payment, the test can be cancelled by us at any time.

7. PERSONAL PROPERTY: The school accepts no liability for personal property that is left in any training vehicle.

8. MOBILE PHONES: All pupils should ensure that these are switched off, prior to entering the tuition vehicle, for safety reasons. Due to recent changes in the law your Instructor will not use a mobile phone whilst the vehicle is moving on a driving lesson.

9. WEATHER: The school has the right to charge the full tuition fee / test fee if lessons / tests are cancelled due to adverse weather conditions. PRIVACY STATEMENT We believe that your privacy is important.

10. Intensive courses must start within 6 months of purchase

Once a deposit / full payment has been received then you the pupil have agreed to our terms and conditions, the pupil has a period of 6 months to complete the course from the date of deposit / full payment is purchased, should we not hear from the pupil for a period of 6 months (e.g if you have lost interest, decided not to go ahead with the course, the course is not for you, changed your mind about learning to drive with us, etc…..) then the deposit / full payment is forfeited and any test fees lost, Cooling off period:

Once a course deposit or full payment is paid, you the pupil have agreed to www.daviddriving.co.uk terms and conditions, you have a period of 14 days from the day after the payment date in which you are entitled to request a refund, however, you waive the right to the 14-day cooling-off period if you have booked a course to start within this period, meaning that lessons will be arranged within this period and tests that need booking will also likely to be in this period. You have the choice to book for a later date to give yourself 14 days to think about it, but if you choose to start within the next 14 days, you have entered the contract early which means we are entitled to refuse any refund. 

You have 14 days from first booking to request a refund, any time after 14 days becomes non refundable (if you start/book the course in before the 14 day cooling off period then the course payment becomes non-refundable). 

**Any refunds that are due will be refunded back on to the card where the payment was made from, alternatively a cheque will be posted out to the person named on the payment order, no other ways of refunds will be processed**

Your personal information which we receive from our site is securely processed and used for our mutual business only. In addition to this, as laid down by the UK Data Protection Acts of 1984 and 1998, we follow strict security procedures relating to the storage and disclosure of information which you have given to us, to prevent unauthorised access. We never release or sell your details to any third party.

 

Intensive/crash course 

Your Driving Instructor will be fully approved by the DVSA who will ensure that you are advised with complete frankness concerning your training needs.

All instruction will be one-to-one. No passengers will be carried in your car without your prior approval.

The driving sessions are generally between 8am to 10am, 12.30pm to 2.30pm and 3pm to 5pm. These timings may change if your Driving Instructor has a student taking a driving test.

We always prioritise driving tests and will adjust the course timings for an existing student when you go to test. The timings may also change in the event of a breakdown as some things are out of our control. We will make up any time owed as soon as possible once the vehicle is repaired.

You are insured for liability claims whilst driving the school’s vehicles when accompanied by an instructor or a Driving and Vehicle Standards Agency Examiner.

There will be no smoking in the car at any time. The mobile phone will be switched off throughout the lesson.

To try to safeguard your personal property but we will not accept liability for anything that you leave in vehicles.

We will advise you, when you are ready to attempt your Practical Driving Test and this will be based on successfully passing a mock driving test.

This will be conducted on the same criteria required to pass your DVSA test. If in your Driving Instructors opinion you do not pass this test then we will plan an appropriate and cost effective remedy.

If you do not pass your practical driving test first time we will correct any serious or dangerous faults outlined on the DL25C test report free of charge.

You will be responsible for your instructors car hire fee and test fee for any subsequent tests.

We reserve the right to use a different Driving Instructor and car.


 Your Promise

To be in possession of a current provisional driving licence, both parts and capable of reading a car number plate from 67 feet (20.5m) during all lessons.

Not to attempt to drive under the influence of alcohol or drugs. (Heavy drinking the night before a lesson may mean you are still over the legal limit for driving the next day. If you are taking any drugs / medication, ask your doctor if they will affect your driving.)

To understand that a vehicle may not be made available for your driving test if your account is not in credit at the time of the test appointment or if you have not been signed off as test ready.

Your Driving Instructor will wait 15 mins at the agreed pick up point before deeming the lesson cancelled unless agreed otherwise. This time for the abandoned lesson will still be chargeable as per current price structure.

Any lessons cancelled after your intensive course with your instructor require 48 hours notice otherwise they will be chargeable as per current price structure.

Due to this, Intensive course fees are not refundable but dates can be changed if given 21 days notice. A £25 administration charge is made to change course dates. All courses must be paid for at least 4 weeks in advance.

Unfortunately, cancellation due to illness if less than 21 days notice is given will result in the loss of your course fee.

Course dates can only be changed once, within a 3 Month period of the original course commencing.

We will fast track your practical driving test when your instructor has signed you off as test ready. By their very nature cancellations are unpredictable and we do not imply any guarantees but to date we have never failed to find an earlier test slot for our students. Generally, we are finding earlier test slots within 3 – 10 working days but this can be more difficult in the summer months.

At the moment there is a backlog of tests due to the Covid-19 lockdown. We are waiting for DVSA guidance and cannot be held responsible for any Coivid-19 related issues.

It is your responsibility to liaise with your instructor regarding their availability for your test date and not to accept a cancellation if they are not available. If your instructor is not available we will endeavour to find you a replacement but cannot guarantee, neither can we guarantee the make and model of the vehicle. Failure to check with your instructor could lead to a loss of your DVSA test fee as the DVSA require at least 4 working days’ notice to cancel your test slot.

With COVID-19 expected to still be a risk for a long time to come, and social distancing to some degree necessary post lockdown, we have put measures in place to make our classroom training and driver training as risk free as possible for you, our staff and our instructors.

Under certain circumstances, if the instructor feels that after 6 months from the course start date, the student hasn’t/can’t meet the requirements to pass the DVSA driving test, we will terminate the course. A 25% refund will be issued using the same payment method.

Unforeseen circumstances

1.1. We shall have no liability for delays or failures in delivery or performance of our obligations to you resulting from any act, events, omissions, failures or accidents that are outside of our control (‘Force Majeure’), which, without limitation, include:

1.1.1. Strikes, lock-outs or other industrial action.

1.1.2. Shortages of labour, fuel, power, raw materials.

1.1.3. Late, defective performance or non-performance by suppliers .

1.1.4. Private or public telecommunication, computer network failures or breakdown of equipment.

1.1.5. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

1.1.6. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or extreme weather conditions.

1.1.7. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
